EJ Yachts Terms and Conditions of Use

Welcome to the EJ Yachts website (“Site”). These Terms and Conditions govern your access to and use of the Site, including all content, information, and services provided by EJ Yachts, a premier yacht charter agent. By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By using this Site, you affirm that you are of legal age and capacity to enter into this agreement. If you do not agree to these Terms, you must not use or access the Site.

2. Disclaimer Regarding Charter Vessels and Itineraries

A. Information Accuracy

All information regarding vessels available for charter on this Site (collectively, “Vessel Information”) is provided in good faith and obtained from sources believed to be reliable. However, EJ Yachts and its agents make no representations or warranties as to the accuracy, completeness, or reliability of this information (including vessel specifications, availability, charter rates, images, or condition).

B. Charter Status

The Vessel Information may be subject to prior booking, rate change, or withdrawal without notice. It is your sole responsibility to confirm the vessel’s availability and the accuracy of any charter itinerary with an EJ Yachts representative.

C. No Offer to Contract

The display of Vessel Information does not constitute a confirmed offer to charter. The booking of any yacht charter is subject to a formal, written Charter Agreement executed by all parties and full verification of the vessel’s suitability.

3. Intellectual Property Rights

A. Ownership

All content on this Site, including but not limited to text, photographs, graphics, logos, videos, software, and the compilation of Charter Information (collectively, the “Content”), is the property of EJ Yachts or its licensors and is protected by copyright, trademark, and other intellectual property laws.

B. Limited License

EJ Yachts grants you a limited, non-exclusive, non-transferable license to access and view the Content solely for your personal, non-commercial use in considering a yacht charter.

C. Restrictions

You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content without the express written consent of EJ Yachts. Specifically, the commercial use of vessel photographs is strictly prohibited.

4. User Conduct

You agree to use the Site only for lawful purposes and in accordance with these Terms. You shall not use the Site:

In any way that violates any applicable local, national, or international law or regulation.

To transmit or procure the sending of any advertising or promotional material without our prior written consent (“spam”).

To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by EJ Yachts, may harm EJ Yachts or users of the Site.

5. Limitation of Liability

EJ Yachts, its affiliates, directors, officers, employees, agents, or licensors shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with:

Your access to, use of, or inability to use the Site or the Content.

Any errors or omissions in the Vessel Information or Content, including reliance on information provided.

Any damage caused by viruses or other technologically harmful material that may infect your computer equipment or data due to your use of the Site.

Your sole remedy for dissatisfaction with the Site is to stop using the Site.

6. Indemnification

You agree to defend, indemnify, and hold harmless EJ Yachts, its affiliates, licensors, and service providers, and its respective officers, directors, employees, contractors, agents, and representatives from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [Client’s State/Jurisdiction, e.g., Florida], without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to the Site shall be instituted exclusively in the federal or state courts located in [Client’s County/City, e.g., Fort Lauderdale, Florida].

8. Changes to the Terms

EJ Yachts reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will post the changes on the Site and update the “Effective Date” at the top of this page. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
